Terms and conditions
The contract for quoting, booking and treating. Australian Consumer Law rights are not excluded.
These Terms and Conditions (“Terms”) are the contract between you and One Stop Pest Management Services when you enquire, book, or have pest control, timber pest inspection or related work done. The Refunds, cancellations and deposits policy, Privacy policy and First aid, emergencies and chemical safety page form part of these Terms.
If you are a consumer under the Australian Consumer Law (ACL) — which includes most household jobs and many business jobs priced at $100,000 or less — you have guarantees that we cannot take away. A “no refunds” line does not override those guarantees. See Consumer guarantees and the Refunds policy.
1. Who we are
One Stop Pest Management Services is a licensed pest management business based in Albion Park, New South Wales. The technician you deal with is Brad Watkins, pest management licence 5072681 (NSW Environment Protection Authority). Phone 0410 890 387. Email onestopbrad@hotmail.com. ABN is shown on the invoice.
We carry out commercial, industrial and residential pest management across the Illawarra, including Albion Park, Shellharbour, Wollongong, Dapto, Kiama and nearby suburbs listed on this website.
We are not a medical service, hospital, ambulance, veterinary practice, builder, structural engineer, licensed asbestos assessor, electrician or plumber. Advice on this website and on a job is pest-management advice, not medical, legal, building or financial advice.
2. How a contract is formed
A contract is formed when you do any of the following:
- ask us to attend and we accept the booking (phone, text, email or website form);
- accept a written or spoken quote and we schedule the work;
- let us start work at the property after we have explained the job and the price;
- tick the quote-form box agreeing to these Terms.
If you book for someone else (a tenant, a parent, a company, a body corporate), you promise you have authority to bind that person or entity and to give us access. If you do not have that authority, you are personally responsible for the charges and for any loss that causes.
We may refuse or cancel a job if the site is unsafe, if we are not licensed for the work, if the pesticide label does not allow the use you want, or if you have not paid a required deposit.
3. Quotes and bookings
Website and phone quotes are estimates until we have seen the property or you have given enough detail for a firm price. A quote may change if the pest, the size of the site, access, the product required or the amount of preparation is different from what you told us.
Quotes are in Australian dollars and, unless we say otherwise, exclude GST if GST applies. The invoice is the final price for the work described on it.
A quote is not a guarantee that a particular pest will never return. It is an offer to carry out the described treatment or inspection for the quoted fee, on these Terms.
We may ask for a deposit to hold a date, to order termite or rodent products, or for larger commercial jobs. Deposits are dealt with in the Refunds policy.
Appointment windows are estimates. Traffic, a previous job running long, weather, or an emergency call-out can move us. We will contact you if we are going to be substantially late. We are not liable for your lost time waiting, except to the extent the ACL requires.
4. Your responsibilities
You must:
- give us safe, lawful access at the agreed time, including parking, keys, gate codes, roof-void hatches and subfloor doors where the job needs them;
- restrain dogs and other animals so we can work without being bitten or blocked;
- tell us, before we spray or bait, about children, pregnancy, asthma or other chemical sensitivity, fish tanks, ponds, aviaries, bees, pet birds, reptiles, and any person who cannot leave the building;
- tell us if the property is a unit, strata, boarding house or residential complex, or if a school, childcare centre, hospital, nursing home or similar sensitive place is within 20 metres of where we will treat outdoors — NSW pesticide notification rules may apply and we need that information from you;
- tell us about previous pest treatments, bait stations already on site, and any warranty you think you have with another company;
- tell us about asbestos, live electrical hazards, unsound floors, roof-void collapse risk, or anything else that could injure a technician;
- obtain permission from the owner, landlord or body corporate if you are not the owner;
- follow the aftercare and re-entry times we give you, and the APVMA-approved label directions for any product left with you;
- not move, open, damage or allow children or pets to interfere with bait stations, traps or monitoring devices;
- pay the invoice in accordance with clause 15.
If we cannot finish because you did not prepare, were not home, refused access, or the site was unsafe, we may charge a reasonable call-out or wasted-attendance fee as set out in the Refunds policy and we may reschedule the remainder at a further charge.
5. Preparing the property
Unless we agree otherwise in writing, you must, before we arrive:
- clear kitchen benches, stove tops and the floor at the kickboards so German-cockroach work can be done;
- put away food, food-prep gear, pet bowls, children’s toys and toothbrushes from areas to be treated;
- cover or remove fish tanks and turn off their air pumps if we tell you to;
- pick up clothing and clutter from skirtings and from the floor of rooms being treated;
- unlock meter boxes, sheds and subfloors we have said we need;
- for end-of-lease or vacant work, have the property empty enough that we can treat skirtings and wet areas.
We can refuse to spray over food, dishes or people. That is a legal and label requirement, not optional.
6. How we work
We will:
- hold a current NSW pest management technician licence for the work we take on;
- use pesticides that are registered by the Australian Pesticides and Veterinary Medicines Authority (APVMA) or used under a valid APVMA permit;
- follow the approved label (or permit), including rates, places of use, re-entry and withholding periods;
- take reasonable care and skill — this is also an ACL consumer guarantee;
- explain in plain English what we are doing, what to pack away, and when people and pets can return;
- make a pesticide-use record as required by the Pesticides Act 1999 (NSW) and the Pesticides Regulation 2017, generally within 48 hours, and keep it for at least three years;
- give prior notice of outdoor pesticide use next to a sensitive place where the Regulation requires it, if you have told us the sensitive place exists.
We may use gel bait, spray, dust, locksable bait stations, traps, monitors, or a mix, matching the pest and the site. You do not choose the active ingredient unless a label, a food-business specification or a written program says otherwise.
We may take photographs of pest evidence, access, conducive conditions and completed work. Those photos are job records. See the Privacy policy.
You must not ask us to use an unregistered product, to over-apply, to spray against a label, or to treat in a way that would injure people, pets or the environment. We will refuse.
7. Pesticides, re-entry and aftercare
Re-entry times come from the product label and from what we tell you on the day. They can differ between an internal gel, an external spray, a dust in a void, and a rodent bait. If you go back in early, or you let children or pets in early, you do so against our instructions.
Wash-up, wiping benches, packing food back, and keeping bait stations in place are your jobs after we leave, except where we have said we will return to collect or top up stations.
Rodenticides and some other products can kill pets and wildlife if they are eaten or if a poisoned rodent is eaten (secondary poisoning). You must keep bait locked, tell other occupants, and not place household poisons on top of our program.
If someone is exposed to a pesticide — swallowed, in the eyes, on the skin, or breathing spray — follow the first-aid directions on the label and the First aid page. Call 000 in an emergency and the Poisons Information Centre on 13 11 26.
Safety Data Sheets for products we use are available on request.
8. Bites, stings, accidents and Triple Zero
Pest control is carried out around venomous spiders, stinging insects, rodents and treated chemicals. Bites, stings, falls, allergic reactions and chemical exposure can happen at a property whether we are there or not. The occupier of the property remains responsible for the safety of people who live there, visit, or work there.
If it is an emergency, call Triple Zero (000) first. Do not call us first. Then, if you can, call 0410 890 387. Full first-aid steps for funnel-web and large black spiders, redbacks, other bites, and pesticide exposure are on the First aid, emergencies and chemical safety page.
We are licensed pest technicians. We are not doctors, paramedics, or a first-aid business. We do not offer medical treatment as part of the service. If someone is hurt while we are on site we will call 000. Any help we give until ambulance arrival is ordinary assistance by a private person, not professional medical care.
To the maximum extent the law allows, we are not liable for bites, stings, allergic reactions, poisoning, or other injury caused by pests that live on the property, by your animals, by your failure to follow re-entry or bait instructions, or by a visitor who ignores warnings — except where the ACL or other law says we cannot exclude that liability (including where the injury was caused by our failure to use due care and skill in carrying out the service).
You must tell other occupants, tenants, cleaners and visitors about wet spray, bait stations and re-entry. If you do not, and someone is exposed or injured, that is your responsibility to the extent the law allows.
9. Results — treatments are not a lifetime guarantee
Pest management reduces pest pressure. It does not make a building pest-proof forever. German cockroaches, rodents, ants and spiders can be reintroduced on deliveries, in second-hand appliances, through open doors, from a neighbouring unit, or from harbour you did not let us treat.
Unless a separate written warranty or service program says so:
- a general pest spray is a treatment of the areas we can reach on that visit, not a certificate that the building is pest-free;
- we do not guarantee a count of zero cockroaches or ants after one visit — German cockroach jobs often need follow-up;
- we do not guarantee that huntsman or other outdoor spiders will not walk onto the building after rain;
- we do not guarantee that rodents will not return if food, gaps and harbourage remain;
- we do not treat or inspect every cavity, every neighbour’s yard, or every item of furniture unless that is in the quote.
If pests continue and we did not use reasonable care and skill, or the service was not fit for the purpose you explained and we accepted, your ACL remedies apply — see clause 13 and the Refunds policy. If pests continue because the building was not prepared, a neighbour is the source, you washed the treatment off, you moved the baits, or you wanted a result the label cannot deliver, a further paid visit may be required.
Any courtesy re-treat window we mention on the day is an extra promise on top of the ACL, not a replacement for it. It lapses if you have not followed aftercare.
10. Termite and timber pest inspections
A timber pest or termite inspection, unless we agree in writing to an invasive inspection, is a visual, non-invasive inspection of areas where reasonable access is available and permitted on the day. Pre-purchase timber pest inspections are commonly framed around AS 4349.3. Termite management inspections of existing buildings are commonly framed around AS 3660.2. We will tell you which scope we are working to.
A visual inspection:
- does not pull up carpets, cut into walls, lift roof insulation, empty cupboards or move heavy stored goods unless you authorise invasive work;
- cannot see inside walls, enclosed eaves, skillion roofs, locked rooms, or areas that are unsafe (for example a collapsed subfloor or a roof void with no safe crawl);
- is a snapshot on that date, not a warranty that termites will not arrive later;
- is not a structural engineer’s report and does not quantify repair cost;
- is not a certificate that the property has a compliant termite barrier.
Nothing in an inspection report means inaccessible areas are free of termites or damage. If we recommend further invasive investigation, that is a recommendation — we do not carry it out unless you book and the owner agrees to the disturbance.
Reports are for the named client. Third parties (buyers, lenders, agents) who rely on a report without our written agreement do so at their own risk. We may decline to provide a report to a person who is not our client.
Regular inspections reduce the chance of undetected activity. They do not prevent termites.
11. Records, photographs and regulators
NSW law requires us to record pesticide use (who, what, where, when, how much, and weather for outdoor spray). We must keep those records for three years and produce them to an EPA authorised officer if asked. We may also keep quotes, invoices, photos, maps of bait stations and messages.
We may disclose information if the law requires it (EPA, Fair Trading, police, a court) or to our insurer or professional advisers. See the Privacy policy.
12. Payment
Payment is due on the day of the job unless we have agreed a commercial account in writing. We may ask for payment before we leave, or on invoice within the stated period (usually 7 days).
We accept the methods listed on the invoice (commonly cash, card or bank transfer). Title in any goods we supply (bait stations, monitors) stays with us until paid for, unless they are installed as part of a treatment you have fully paid.
Overdue amounts may be referred for collection. You must pay our reasonable collection costs to the extent the law allows. We may withhold reports or further visits until the account is clear, except where withholding would be an attempt to avoid an ACL remedy we are required to provide.
13. Australian Consumer Law — what we cannot exclude
In short, we must provide services with due care and skill, that are fit for a purpose you make known and we accept, and within a reasonable time if no time is agreed. We cannot display “no refunds”, “no liability” or “you sign away your rights” in a way that wipes out those guarantees. If we ever said that in conversation, these Terms and the ACL still apply.
Where the ACL allows a supplier to limit remedies for services that are not of a kind ordinarily acquired for personal, domestic or household use, and that limitation is fair and reasonable, our liability for a failure to comply with a consumer guarantee is limited to supplying the services again or paying the cost of having them supplied again. Household pest control is ordinarily acquired for domestic use, so this limitation will often not apply to home jobs. We do not rely on it to take away a consumer’s major-failure remedies.
Unfair contract terms in a standard-form consumer or small-business contract can be void, and proposing or relying on them can attract penalties. If a court or tribunal finds a term in these documents unfair, that term is read down or severed and the rest continues.
Nothing in these Terms excludes liability for fraud, or for death or personal injury, to the extent Australian law does not allow that exclusion.
14. Limitation of liability (as far as the law allows)
This clause applies only to the extent it is consistent with the ACL, the unfair contract terms rules, the Civil Liability Act 2002 (NSW) and any other law that cannot be contracted out of.
We are not liable for:
- change of mind, a cheaper quote elsewhere, or you no longer needing the job;
- pest activity in areas we could not access, were not asked to treat, or that you told us to skip;
- pre-existing timber damage, staining, odour, droppings, or wiring chewed before our visit;
- loss after you (or a tenant, cleaner or visitor) ignore re-entry times, wash treatments off, move baits, or re-infest the site;
- products you or another contractor applied;
- weather, flood, fire, or a neighbouring infestation you did not control;
- lost profit, lost rent, business interruption, missed settlement, or other indirect or consequential loss, except reasonably foreseeable loss that the ACL says you may recover;
- the acts of your employees, tenants, visitors, animals or other contractors.
Where we are liable and the law allows a cap, our total liability arising out of a job is limited to the amount you paid us for that job (or the cost of re-supplying that job), except for ACL remedies that cannot be capped, and except for liability that the law does not allow us to limit.
You indemnify us against claims by third parties (tenants, visitors, buyers, neighbouring occupiers) that arise from your breach of these Terms, your failure to pass on safety instructions, or your failure to disclose a risk — except to the extent we caused the loss by our own negligence or our failure to comply with a consumer guarantee. We do not ask you to indemnify us for our own wrongdoing.
You occupy or control the site. You must keep it reasonably safe for our technician (restrained dogs, covered holes, known asbestos identified, safe ladders of yours we are not required to use). If your animal injures us, you are responsible to the extent the law allows.
15. Website, insights and social media
This website, including Insights articles, pest photos and suburb pages, is general information for Illawarra property owners. It is not a diagnosis of your pest, not a quote, and not a substitute for a licensed inspection. Photos are illustrative. Species can be misidentified from a photo.
We try to keep licence numbers, phone numbers and service descriptions accurate. We do not warrant that the site is error-free or continuously available. We may change content at any time.
All trade marks, text, layout and original photographs on the site belong to us or our licensors. You may not copy the site to run a competing business. You may share a page using the share tools.
Links to Facebook, Google, NSW EPA, ACCC, Poisons Information Centre and other sites are for convenience. We are not responsible for their content.
Do not submit unlawful, defamatory or misleading content through the quote form. Do not attempt to break the site. We may keep server logs for security.
16. Complaints and regulators
First, call Brad Watkins on 0410 890 387 or email onestopbrad@hotmail.com and explain the problem. We will try to fix a service issue in a reasonable time.

If we attended under an unsolicited consumer agreement (for example certain door-to-door or telemarketing sales covered by the ACL), a 10-business-day cooling-off period and other mandatory rules apply. Most jobs booked because you called us, filled in our form, or asked us to quote are not unsolicited. If cooling-off applies, we will honour it.
17. Governing law, changes and contact
These Terms are governed by the laws of New South Wales, Australia. NSW courts and tribunals (including NCAT where it has jurisdiction) may hear disputes.
If a clause is unenforceable, it is severed and the rest remains. These Terms plus the quote, invoice and any written warranty are the entire agreement for that job. Spoken promises that contradict the ACL still cannot override the ACL.
We may update these Terms for future jobs by posting a new version on this page. The version in force when you booked applies to that booking, except that ACL rights are always the law in force at the time.
Force majeure: we are not in breach if we cannot attend because of flood, fire, pandemic directions, a vehicle accident, or a regulator stopping the product we planned to use. We will reschedule or refund a deposit for work not started, as the Refunds policy and the ACL require.
